TERMS AND CONDITIONS (T&C)

1. GENERAL

1.1

These T&C apply to all users of the "Magic Luna Voice App" as well as purchasers of the "Magic Luna, Power of Lights, Lenormand Fortune-Telling Card Deck".

1.2

The provider reserves the right to amend these T&C at any time. Changes take effect upon their publication on the website and in the app.

2. APP INFORMATION

2.1 Availability

The app is available worldwide in the Google Play Store and Apple App Store, providing a digital platform for card reading where Lenormand cards can be used in an intuitive and interactive manner.

2.2 App Features

Lenormand Reading Systems: Three reading systems are available. The cards can be digitally shuffled, drawn, and interpreted.
Language Support: The user interface is available in six languages: German, French, Italian, English, Spanish, and Portuguese. Additionally, users can select more languages for questions and answers from an ever-expanding list.
Widget: A widget allows quick and easy access to daily messages.
Special Feature: Users can interpret their own physical readings by entering card numbers. The activation of this feature is enabled via a QR code that is provided with the purchase of a physical card deck.
Note: The QR code is personalized and must not be shared with third parties or made public. Legal action will be taken in case of misuse.

2.3 Financing

The app is free and funded through advertising. No paid subscriptions are available.

2.4 Disclaimer

The app is for entertainment purposes only. No liability is assumed for responses generated by generative artificial intelligence.

3. LENORMAND CARD DECK INFORMATION

3.1 Product Details

The deck consists of 36 traditional Lenormand cards and two alternative versions of card 28 (The Man) and card 29 (The Woman). No card descriptions are included in the packaging.

Card descriptions are available in six languages; German, French, Italian, English, Spanish, and Portuguese - on the official website.

3.2 Production and Distribution

Production: The cards are produced in China and shipped worldwide directly from the warehouse in China.
Payment: Purchase is only possible via major credit cards. Purchase on account or installment payment is not available.
Packaging and Shipping: The cost of packaging and shipping is included in the price. Customs fees are borne by the buyer.
Delivery Time: The delivery time is 7–14 days. Unforeseen delays due to international shipping conditions cannot be ruled out.

3.3 Return Policy

Returns are possible within 14 days, provided the cards are unopened and undamaged.

Return address: CRI Vision GmbH, Blegistrasse 11a, CH-6340 Baar. The buyer bears the shipping and return costs.

Refunds are processed through the original payment method after the goods have been inspected.

For damaged goods or complaints, use the contact form on the website under "CONTACT".

3.4 License Conditions

Cards must not be resold.

For any public or commercial use, a paid license is required. Interested parties must get in touch via the contact form on the website under "CONTACT" and specify the intended purpose. Use without a license is strictly prohibited.

Legal action will be taken in case of violations.

4. INTELLECTUAL PROPERTY AND COPYRIGHT

4.1 Trademark and Copyright

The brand is registered as an individual trademark in the trademark register.

All content of the app, the Lenormand card deck, and the website, including texts, graphics, logos, designs, features, and software, is copyright-protected.

The brand's face is registered and copyright-protected. It was created using generative artificial intelligence tools I and does not represent a real person.

4.2 Usage Rights

The content of the app, card deck, and website must only be used for personal and non-commercial purposes unless an explicit written permission or commercial license is granted.

Any reproduction, distribution, public performance, modification, or other use of the content is prohibited without prior written consent from the provider.

4.3 QR Code

The QR code provided with the purchase of the card deck is personalized.

It must not be shared with third parties, duplicated, or published.

4.4 Legal Consequences

The provider reserves the right to take legal action in case of copyright or trademark violations.

5. AGE RESTRICTION

5.1

The use of the app and the card deck is permitted only for individuals aged 16 and above.

6. WEBSITE POLICIES

6.1 Language Support

The website is available in six languages: German, French, Italian, English, Spanish, and Portuguese.

6.2 Communication

Order and shipping confirmations are sent via email in the language chosen by the user.

The invoice is automatically generated upon order completion and also sent via email. The invoice is only available in the main language of the seller, "German".

7. LIABILITY

7.1

The products offered comply with the national laws of the country in which the provider has its business establishment. To the extent permitted by law, the provider therefore expressly excludes any liability in particular if the delivered goods do not comply with the laws of the destination country, provided that this is not the country in which the provider has its business establishment.

7.2

Customer claims for damages are excluded to the extent permitted by law.

7.3 Force Majeure

The provider is not liable, to the extent legally permissible, for any defect or breach of contract in fulfilling an obligation if it is due to an event of force majeure.

Force majeure means, among others:

War, acts of war and hostilities, riots, or civil unrest,
Strikes, lockouts, trade disputes, or labor disturbances,
Shortage of raw materials or fuel, failure or partial failure of facilities or machinery, regardless of whether they belong to the provider or an affiliated company of the provider,
Accidents and natural disasters such as fire, explosion, flood, or pandemic,
Difficulties, delays, or increased costs in obtaining materials or means of transport,
Laws, orders, or regulations issued by the government of a country or on its behalf, interventions by customs, tax, or other authorities, any type of customs duties, tariffs, taxes, or other governmental bodies,
Or other circumstances beyond the reasonable control of the provider that affect the production, delivery, or availability of the products.

8. FINAL PROVISIONS

8.1 Applicable Law & Jurisdiction

All legal relationships between the provider and the customer are governed exclusively by Swiss law, excluding its international treaties, in particular the United Nations Convention on Contracts for the International Sale of Goods (CISG), and excluding the non-mandatory conflict-of-law provisions of the Swiss Federal Act on Private International Law (PILA). The place of performance is the registered office of the provider.

The place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the registered office of the provider.

8.2 Contract Content, Completeness, Validity of Provisions, Amendments to the T&C

This contract contains all agreements made between the parties regarding the subject matter of the contract. There are no verbal side agreements.

If any provision in these terms of sale is invalid, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

The contract remains binding in its remaining parts even if individual provisions are legally invalid. In place of the invalid provisions, the statutory provisions shall apply where available.

If no applicable statutory provision exists in the respective case (regulatory gap) or if it would lead to an unacceptable result, the parties shall enter into negotiations to replace the invalid or omitted provision with a valid regulation that comes as close as possible to the intended economic purpose.

The provider reserves the right to make changes to the website, policies, terms, including these terms of sale, at any time.

The customer’s order is subject to the terms of sale, contractual terms, and general terms and conditions that are in effect at the time of the order, unless a change to these terms is required by law or official order (in such a case, they shall also apply to previous orders to the extent legally permissible and necessary).

8.3.

It is not permitted to use images or other content from the provider’s website without the provider’s express written consent.

8.4.

The German version of these T&C is the original version. In the event of any discrepancies in another language version, only the German version is legally binding.
